The Criminal Side of NY Personal Injury We tend to speak about the dangers involved in negligence cases, and the personal injury that ensues. But there is another aspect to personal injury -- the criminal side. This is the criminal side. Take this well know case of NY City crane collapse in May 2008. Apartment properties were damaged, walls broken, and pedestrians injured. No doubt, personal injury lawsuits ensued. Worst of all, two construction workers were killed. But now comes the second stage. According to the NY Times, NY prosecutors recently charged the crane owner and mechanical engineer with negligent homicide and manslaughter. In our opinion, both aspects of personal injury law help protect citizens from injury. Business owners should be held responsible if they create dangerous conditions for their employees. Where fear of making monetary compensation may fail at deferring, fear of going to jail may succeed. We call it the Right-Left defense of the innocent. That is personal injury lawyer's opinion.

Bronx Supreme Court. On July 19, 2004, Ruth K., a 71 year-old retiree, rode an NYC Transit Authority Access-A-Ride minibus, while sitting in her husband's old wheelchair. The driver drove for a few blocks in the Bronx. A nearby parked car pulled away from curb, and cut off the minibus. The driver suddenly stopped the bus. Ruth went flying onto the floor, fracturing several parts of her body. Ruth sued the bus company, MTA, and the NYC Transit Authority.
